Al-Alimi takes advantage of his presidential position to bypass the judiciary in Hadhramaut (documents)

An official memorandum issued by the Presidency of the Republic revealed the involvement of the Director of the Presidency Office, Abdullah Al-Alimi, in exploiting his functional influence to interfere with the land file in Hadhramaut and issue illegal executive directives that bypass the independent judiciary.

In the presidential memo, Al-Alimi directed the governor of Hadhramaut to "direct commitment and absolute compliance with the implementation of what he described as" final and definitive judicial rulings and orders "issued in the case of Bahaidan and Bin Malik real estate, while the case is still pending before the West Mukalla Court, according to the testimony and confirmation of the court judge in his attached memorandum.  

Al-Alimi’s memorandum was contradictory in time, as he said that the presidency received a letter from the Bin Malik Corporation for Trade and General Contracting submitted to the President of the Republic on 1-1-2020, while his memo, which overrides the judicial authority, issued on 2-29-2019 No. 155 / MR / 99 M.

While Judge Saeed Khamis Ali Belbheth, President of West Mukalla Court of First Instance, confirmed in a memorandum issued by him on 9-10-2020 addressed to the General Director of the General Land Authority, M / H, and the director of security and police, M / H, that there is a case pending In front of court.

Judge Belbheid said that, based on the request submitted by “Abdulsalam Ahmed Saeed Bab Ibrahim (Badaad) regarding the statement of the existence of a case pending before the court against the Bin Malik Foundation and the Bahaidan family .. we assure you that the applicant, Abdulsalam Ahmad Bab Ibrahim (Badawad), filed a civil case against all from the Bin Malik and Al Bahaidan Foundation, the case was pending before us, and then it was referred to Judge Adeeb Salem Bahartha, head of the court, and that the case is still pending before him.


The memorandum of the President of the West Mukalla Court confirms that the Director of the Presidency Office has committed a grave legal violation for which the law is held accountable, as it is an infringement of his specific functional powers and a blatant interference in the tasks and affairs of the judiciary as the highest executive authority, and an exciting intrusion of the Presidency of the Republic in a case before the judiciary and making it a mount and a justification before the State Lands Authority taking measures contrary to the authority of the judiciary in being involved, the week before last, with the demolition of the home of the Hadrami investor Abdul Salam Ahmed Bab Ibrahim Badawud and removing the wall of his land surrounding it in the neighborhood unit 2 D1, Sittin Street in front of the Mukalla platform, despite his possession of a trade union document, receipt and usufruct contracts on that land and building and completion licenses for every legal process.
