Hadi violates the constitution and the law and appoints the Speaker of the Shura Council and the General Prosecutor

President Abd Rabbo Mansour Hadi renewed his horrific violations of the constitution of the Republic of Yemen and the laws in force by issuing decisions contrary to the constitution that decided to appoint a speaker for the Shura Council and a deputy general of the republic.

On Friday, President Hadi issued Republican Decree No. (3), appointing Dr. Ahmed Obaid bin Daghr as Chairman of the Shura Council, and Resolution No. (4), and decided to appoint Dr. Ahmed Ahmed Saleh Al-Mosawi as Deputy General of the Republic, both of which include grave breaches of the provisions of the Constitution and the laws in force.

The decision to appoint Bin Daghr contradicts the provisions of Articles (26, 27, 28, 29, and 30) of the Law on Attempting the Position, which stipulate that the Speaker of the Shura Council and his deputies are elected in a secret manner by the members of the Council and are not appointed by Republican decisions.

Also, the decision to appoint Ahmed bin Daghr comes after his dismissal from the prime minister and referring him to investigation on October 15, 2018, and no court ruling was issued acquitting him or convicting him of the charges against him that were mentioned in a previous presidential decision.

 In the same context, the decision to appoint Major General Ahmed Al-Mosawi as Attorney General of the Republic includes numerous violations of the provisions of Articles (56, 57, 61, and 62) of the Judicial Authority Law in the Republic.

The law requires obtaining a certificate from the Judicial Institute or working in the Public Prosecution and spending a two-year training period, and this is not available in Major General Ahmed Al-Mosawi.

The Judicial Authority Law stipulates competence, integrity, and the nomination of the Attorney General by the Supreme Judicial Council before issuing a decision appointing him by the President of the Republic, as it is an important condition for ensuring the principle of the independence of the judiciary.

These are not the first violations of President Abd Rabbo Mansour Hadi, as he preceded them with dozens of republican and presidential decrees that contravene articles and texts of the constitution and laws for public office employment in civil, military and security institutions since the beginning of the war.

 It is noteworthy that the continuing violations make the president residing outside the country and his controlling Brotherhood team, by making decisions, another version of the Iranian Houthi gang usurping power in Sana'a.
