The Specialized Division refuses to accept the appeal of the Criminal Prosecution regarding the case of Martyr Adnan Al Hammadi

On Tuesday, the Specialized Criminal Division in the capital, Aden, decided not to accept the appeal of the Specialized Criminal Prosecution to the decision issued by the Criminal Court regarding the case of the martyr Adnan Al Hammadi, which stipulated that the case file should be returned to the Specialized Criminal Prosecution to proceed with the investigation and disposal procedures.

Activist writer Adel Al-Barti said, in his publication, that this is the second time that the judiciary has revealed the meager role of the Public Prosecution in the case of the martyr Major General Adnan Al-Hammadi.  At the same time, he accused the Public Prosecution Office of standing with the perpetrators, contrary to its mission of revealing the truth, prosecuting the perpetrators and bringing them to justice to receive their deterrent punishment.

 He added, "In the Al Hammadi case, as described by the blood parents' lawyers since the beginning of its investigation in the case, the prosecution worked with great determination to obliterate the features of the crime and limit it to the direct perpetrators only (tools) without the rest of the partners from the financiers, planners and instigators, and it was quick to bury the truth and obliterate all the features that indicate  To the rest of the participants in the crime through her lack of seriousness in the investigation, and she turned a blind eye to most of the requests submitted to her by the lawyers of the blood parents and concealed them from the hard communications and removed them to approximately 250 papers.

Al-Barti indicated, quoting the lawyer of the blood relatives, that the indictment was prepared in a hurry and the accusation was confined to the tools of the detainees only, without the rest of the financiers, planners and instigators.  Noting the consequent obstruction of the trial procedures by it by not bringing the accused to the trial sessions and directing its members to boycott the sessions before the predecessor judge Wahib Fadl.

He pointed out that the sessions were suspended for nearly a year and a half, and the case procedures were returned before Judge Al-Shuaibi, who issued a historic ruling that accepted the request to respond submitted by the lawyer of the blood parents and return the case file to the Public Prosecution to investigate all those who participated, incited, contributed or financed the commission of the crime, whether they were persons  Legal entities, news websites or channels, whether or not they are included in the application submitted by the blood parents’ lawyer.

Al-Barti, who is interested in the case of the trial of the killers of the martyr Al-Hammadi, expressed his astonishment at the position of the prosecution in this case, explaining that instead of carrying out its duty, we find it boldly and insolently submitting an appeal against that fair ruling in the face of the guardians of blood with the aim of enabling the rest of the perpetrators to escape punishment and obliterate the features  their crime.

Al-Barti considered the prosecution’s attempts to waste more time and effort in order to serve the perpetrators and meet their desires and goals, praising the integrity of the judiciary, which returned the prosecution disappointed for the second time, as it triumphed for the truth and justice sought by parents and society by virtue of the Criminal Division not accepting the appeal submitted by the Public Prosecution.

While Al-Barti questioned how people would trust that the Public Prosecution office would win the blood of the victims and would carry out its duty to pursue, arrest and investigate the killers in light of its current reality, he insisted on not rushing to pass judgments and waiting for the procedures that the Public Prosecution will take in this case in the coming days in light of  The ruling of the court and under the leadership of the Public Prosecutor, Judge Qaher Mustafa.
